Already we have seen that the update has stopped users from being able to, albeit this was a small bug and not a deliberate attempt by Sony to deter piracy. But it has also been discovered that the firmware contains a rootkit that allows Sony to perform remote code execution when a console is connected to the PlayStation Network. In plain English this means that certain files could be scanned and detected by Sony i.e.
Custom firmware/homebrew applications, and a report sent back about them. We are not sure how accurate this is, or what Sony would do with this info, but if true it could be one way for Sony to detect potential security breaches on the system and allow it to implement future updates to combat problems (this perhaps could be with games that have been exploited, anyone?). Back in the 80’s, when DOS was King; Microsoft did something similar. You installed DOS – and MSFT scanned your hard drive and made a file of all the executable programs on your disk – with their activiation codes. The intent was that at some point in time, this file could be read and MSFT could determine the legitimacy of every program you had ever installed – and then charge you with piracy or force you to purchase that software. This was solved with a Class Action Lawsuit for Invasion of Privacy – and a HUGE fine (at that point in time) was levied – since then, MSFT has steered well clear of anything approaching this attempt.
